The Old Hose Job.

I see it becoming more frequent lately, but when you sign a deal to Write/ Draw a comic and come to find later that the person who employed you was less than honest and leaves you hanging it can be devastating. I've been through it, I know of dozens of others who have as well, and the only way it will stop it seems to me is to name names.

I tried this action before, and was met with resistance, as if it was a crime to name those who would cheat you and others. You expect people would want to know who's Bad News or who to Trust. But they give the argument that talking ill of others looks bad on you.

Back in 1999 I got a contract signed with Kirk Lindo at BrainStorm Comics to draw pin-up's for a few books, I was promised payment after the books hit the shelves, as the story goes Kirk Lindo stopped returning my phone calls and letters sent by Mail. He just disappeared. I drew over 31 pin-up's and later found out he sold everyone of them on Ebay and kept that money on top of publishing my work. I even tried to file a small claims case, but he no longer (or never did0 have an office at the address in the comic, so I really had no recourse.

A year later I found out Kirk Lindo has done this to dozens of people, writers, artists, etc. over the years. And I thought if I had known about this guy I would have never submitted work to him, it was a hard lesson.

It is very important to know who you are working with, contracts mean nothing if they are not actionable, you need a physical address, phone number, meet in person if possible. Do some research, google works great!

It takes a real low life scumbag to seek out hopeful artists and writers and steal from them, and smile while doing it, so wake up cause they are out there and there's a lot more of them now.

So KIRK LINDO, you're on the list buddy!

Oh I don't doubt it. I've never seen someone ge so incensed about defending someone else without having a personal stake in their life. He's either Kirk Lindo or someone very close to him. Or some rabid fanboy. ;)

Here is my response to Kirk Lindo:

I never missed a deadline. The only problem You had with my first 4 pin up's was how the hair was drawn and you sent me reference so I can get it right, and you even complemented my work after that.

There was no notice or verbal indication that I would be or was ever fired.

Publishers like you should be out of business, you have no morals or ethics, and I have a fountain of support of claims against you that will be published soon. You brought this on yourself, and I expect you won't go down without kicking and screaming, but you will. Doesn't matter how old the claims are either, it is a pattern of your behavior that will be established and up for public record.

Also, I claimed $3.000.00 on my small claim, and was just for all the pin-up's you sold on Ebay and kept the money. That's $100 per page, but I would settle for $1500 if you offered it.

ALso, I have no Idea which pin-up's were used because after the Vamperotica pin-up special, no Artists were given credit in any books after that, and in Buxotica there wasn't even any publishers indica/ address info.

If what he posted about the contract is true (and it might be, I don't feel like reading it all) the terms are draconian and probably wouldn't hold up in court at all. It basically said that the publisher can ask for whatever changes they want and if you don't make them they can simply not pay you and keep everything. That sounds like slave labor not a legal contract.

That's the real contract! I was a genius move because now people can see how Kirk Lindo conducts business. The part about asking for changes doesn't bother me, but he never sent back art for revisions, he was happy with everything I sent from what I remember. If he was not then I should have had art sent back to be reworked to his standards. Here is my detailed response to the terms of the contract [link] In short, Lindo breached the contract himself a few times, and all because he did no communicate.

If he asked for changes, he should return the worj so it could be changed. Revisions are different from redos. He could argue this all day but I doubt it would go anywhere. Not that I have any publishers breathing down my neck for my art but I think I'd avoid Mr. Lindo.

Oh I also that he had 2 comments (one was mine) but both are hidden. Now why would he hide them? There's no slander or profanity in mine. Just innocent questions.

You also have to wonder, if your work didn't meet standards, why publish or sell them? If they did publish the work, did they provide the preview art beforehand like the contract says they should? Ah well, good luck with this, bud.

This is from the contract - "WORK WILL BE CONSIDERED ACCEPTED UNLESS REVISIONS ARE REQUESTED." and that says it all. If revisions were needed he would have had to send back the artwork to be redrawn to meet with his critiques. And that did not happen.

Wow. Some people... are just wow.

It IS always nice to get a heads up about things like this. I've received warnings about a certain person in the past, and while it didn't entirely stop me from working for them, it did ensure that I got payment in full up front. Not everyone might appreciate the calling out, but I'm sure there are also many people who have been taken advantage of at some point wishing that someone had told them the same thing happened x number of times before with the same person.

It's really a shame that so many have to learn the hard way... Well, it's a shame that there is so much screwing over of artists in the first place. :<

Two sides to every story. I did a pin-up for Brainstorm back in the day, got paid, got my art back and had no problems. I'm a collector too and have bought some of Lindo's powergirl art. The guy's art kicks ass and he was always cool to me. I know a few commission art collectors that had some less than cool stuff to say about YOU!

I'm gonna suggest to them that they do the same and put the details about you here on D.A.

I'd like to know who these art collectors are that have negative things to say about me, If it's true I would want to correct any bad feelings towards my work or at least find out what they didn't like about their commission. I haven't had any negative response to my commissions from a collector so this is news to me.

I can tell you are a fan, but don't let that blind you, as I said I am not the only one Kirk Lindo has done this too.

I'd like to see the Pin up you drew, and which book did he publish it in?

I can't say I was a full fledged fan! He had some cool Power Girl art and prints that I liked a lot. But I did buy some of his art in the past and that's why I noticed your post. I'm a little sick of assholes like you and guys like Eric Powell who come to the web to piss and moan because your art career and life sucks. I've been seeing a lot of this lately, mostly by third rate hacks who have never done anything in the industry and I've decided to start a blog about it. I've lined up a few and your on MY list. I have quite a bit to say about guys like you. I'll be back when I get my blog together. I'm not outing anybody who bought from you, but YOU know who they are. I'll give you a hint. They bought from you once and WILL NEVER DO IT AGAIN. If they want to chime in that's up to them.

One last bit of advice. How about you work on YOUR OWN art like I am doing. Maybe you'll get a little better.

You seem to be taking this personal.

I have paperwork to prove my claims, every letter Lindo sent me plus the contract to back up everything I stated, because I tried to get a legal resolution.

I am not pissing or moaning about my Life/ Career, just warning people about others who prey on artists and writers, and my personal experience.

You want to start a blog about third rate hacks who never made it into the industry? Again, sounds personal, but feel free. I find it hard to believe you are an artist with all the vitriol you are spouting here about others who haven't made it for whatever reason.

And thanks for the advice, I will continue to work my ass off to get better.

Yeah Dude, It IS personal! and I'm writing about MY personal experience. But don't hand me that B.S. about you caring about other people. You're just a frustrated tool looking to get attention. And it seems that the only way you can do that besides drawing crappy porn is to go after artists who actually have talent. I was scanning Comic Art fans today and came across another shit-head like you going after Stephane Roux and I'll tell you dude, I just snapped. I'm sick of you hacks with no life so I'm gonna give you back a little of what you give out. I LOVE MY COMICS. If you would stick to drawing I'll have no problem with you but if you pop up on my radar fucking with any artists that I like I'm gonna give you MY opinion, like it or not. I LIKE MARVEL COMICS like X-Men and Thor. Or D.C. Comics Like Batman and I'm sick of dudes like you or Eric Powell who are CLEARLY motivated by your own lack of accomplishment. Who the HELL is Eric Powell to talk crap about comics and characters that I grew up with when his comic is mildly interesting at BEST! So sit tight, I've got some good shit I'm coming up with on you, Powell and Jamie Pilar, He's the asshole who is falsely posting SEXY SEXY art by Stephane Roux only to want to piss on the guy.

You are the most aggressive fanboy I've ever come across, I admire your passion for comics and your heroes, Kirk Lindo is a fraud is all I'm saying.

The difference between us is I have actual proof and experience, and all you have is your opinion. I hope that when YOU do make it into comics that what happened to me never happens to you, and I mean that.

What happened to you will NEVER happen to me because if I do make it, it will be because I spent my time talking about ME, my art. I just double checked your post and it seems that your #1 claim to fame is this deal of yours that went bad back in 1999. Wow! Looks like Lindo did you a favor. No one would really even know who you are without you talking about... SOMEONE ELSE!!!

And I'm really not THAT into Lindo. His work is good and like I said before, I delt with him and everything went smooth. But you're like some pitiful groupie stalker. 1999? You mean like back when CLINTON was in office?

More advice.... Get a LIFE! Better yet... focus on YOUR art and you might even get a career.

Calling him out by name like this is not only acceptable, I look at it as a public service. You've given some good advice here. Perhaps you can find him on ebay, and there is some recourse there? Report him for selling stolen goods?
